Privacy Notice

Sunny Vibes (hereinafter, “Sunny Vibes” or “we”), with address at Av. Pacífico 6, Centro, C.P. 63732, Bucerías, Nayarit, Mexico, is responsible for the processing and protection of your personal data, in accordance with Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), its Regulations, and other applicable provisions.

1. Personal data we collect

For the purposes described in this notice, we may collect the following personal data:

• Identification and contact data: name, email address, telephone number, nationality, and address.
• Data required for the real estate transaction and its formalization: official ID, CURP, RFC (tax ID), and proof of address (for deeds or contracts).
• Financial and asset-related data: when you request financing, submit an offer, or when the transaction requires it by law.

Sensitive data. Sunny Vibes does not collect sensitive personal data. Should any procedure require it, your express consent will be requested beforehand. The processing of financial and asset-related data requires your express consent, which is deemed granted when you provide such data for the purposes stated herein.

2. Purposes of processing

Primary purposes (necessary for our relationship with you)

• To identify you, contact you, and follow up with you as a client or prospect.
• To show, promote, and market properties (purchase, sale, rental, or pre-sale) that match your interests.
• To coordinate property showings and address your requests, questions, and clarifications.
• To manage offers, negotiations, and the purchase or lease process, including the documentation and procedures required for its formalization.
• To comply with legal and tax obligations, as well as, where applicable, anti-money-laundering obligations (real estate brokerage is a “vulnerable activity” under Mexico’s LFPIORPI).

Secondary purposes (not necessary; require your consent)

• To send you information about new properties, pre-sales, promotions, and newsletters.
• To conduct quality surveys and studies to improve our services.

If you do not wish your data to be used for the secondary purposes, you may state so by sending an email to Info@sunnyvibes.mx with the subject line “I do not want secondary purposes.” Your refusal will not be grounds to deny you the services you request.

3. Data transfers

To complete the transaction you request, your data may be transferred, only as necessary, to:

• Notaries public, for the execution of deeds and formalization of the transaction.
• Financial institutions or mortgage advisors, when you request financing.
• Developers, real estate agencies, or associated advisors, when essential to complete the transaction (co-brokerage).
• Competent authorities, when legally required.

Transfers that are necessary to fulfill the legal relationship with you, or that are required by law, do not require your consent under Article 37 of the LFPDPPP. Outside of these cases, we will not transfer your data to third parties without your consent.

4. ARCO rights

You have the right to Access your personal data, Rectify it when inaccurate, Cancel it when you consider it is not required for any of the purposes, and Oppose its processing for specific purposes (ARCO rights).

To exercise them, send your request to Info@sunnyvibes.mx, including:

• Your full name and a means to receive our response.
• A document proving your identity (or legal representation, where applicable).
• A clear description of the data and of the right you wish to exercise.

We will respond to your request within a maximum of 20 business days.

5. Revocation of consent

You may revoke at any time the consent you have given for the processing of your data, as well as limit its use or disclosure, by sending your request to Info@sunnyvibes.mx, following the same procedure described for ARCO rights. Revocation will not apply retroactively, nor where there is a legal obligation to retain the data.

6. Use of cookies and tracking technologies

On our website sunnyvibes.mx we may use cookies and similar technologies to improve your browsing experience and obtain usage statistics. You may disable them through your browser settings, bearing in mind that some site features may be affected.

7. Changes to this privacy notice

This privacy notice may be amended as a result of legal changes, changes in our practices, or in our business model. Any change will be published at sunnyvibes.mx and, where applicable, notified to you through the contact details we have on record.
